By accessing or using Scardo ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users of the Service, including without limitation users who are browsers, customers, or contributors of content.

2. Description of Service

Scardo is an AI-powered sports card scanning and collection management platform. The Service allows users to scan sports cards, identify them using computer vision, organize their collections, track estimated values, and access related market data. The Service may include features such as image recognition, digital collection organization, and market value estimation.

3. User Accounts

3.1 Account Creation

To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

3.3 Account Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service and that they have agreed to these Terms on your behalf.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Harass, abuse, or harm other users or attempt to do so
• Transmit any viruses, malware, or other harmful code
• Attempt to gain unauthorized access to the Service or its related systems
• Use automated systems (bots, scrapers, etc.) to access the Service without permission
• Interfere with or disrupt the Service or servers connected to the Service
• Use the Service to generate content that is illegal, harmful, or violates others' rights
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove any copyright, trademark, or other proprietary notices from the Service
• Upload images that are not related to sports cards or that contain inappropriate content

5. Intellectual Property Rights

5.1 Our Content

The Service, including its original content, features, and functionality, is owned by Scardo and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

5.2 Your Content

You retain ownership of any content you submit, post, or display on or through the Service ("User Content"), including images of your sports cards. By submitting User Content, you grant Scardo a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such User Content for the purpose of operating, improving, and providing the Service.

5.3 AI and Data Usage

By uploading images to the Service, you acknowledge and agree that Scardo may use these images to train and improve its computer vision models and card recognition algorithms.

6. Subscriptions and Payments

6.1 Subscription Plans

The Service may offer various subscription plans with different features and pricing. We reserve the right to modify subscription plans, features, and pricing at any time. Changes to pricing will be communicated to you in advance.

6.2 Billing

Subscription fees are billed in advance on a recurring basis (monthly, annually, etc.) according to your selected plan. By subscribing, you authorize us to charge your payment method for the subscription fee and any applicable taxes.

6.3 Cancellation and Refunds

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. Refunds are provided at our discretion and in accordance with applicable law. We do not provide refunds for partial subscription periods.

6.4 Free Trials

If you participate in a free trial, your subscription will automatically begin at the end of the trial period unless you cancel before the trial ends. You will be charged according to your selected subscription plan.

8. AI, Grading, and Valuation Disclaimers

8.1 AI Technology

The Service uses artificial intelligence and computer vision technologies to identify cards and estimate conditions. While we strive to provide accurate identification, AI-generated results may contain errors or inaccuracies. You acknowledge that AI results are estimates and not guarantees.

8.2 Valuation and Pricing

Any pricing information or value estimates provided by the Service are based on market data and algorithms. These are estimates only and do not constitute a professional appraisal or a guarantee of value. The sports card market is volatile, and prices can fluctuate significantly. Scardo is not responsible for any financial decisions made based on this information.

8.3 Grading Estimates

If the Service provides condition estimates or "AI grading," these are preliminary assessments generated by software. They are not equivalent to professional grading by third-party services (like PSA, BGS, SGC, etc.) and should not be relied upon as such.

9. Service Availability

We strive to provide reliable service but do not guarantee that the Service will be available at all times or free from errors, interruptions, or defects. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

10. Termination

10.1 Termination by You

You may stop using the Service at any time by canceling your subscription and deleting your account.

10.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice, if you violate these Terms or engage in any conduct that we determine, in our sole discretion, is harmful to the Service, other users, or our interests.

10.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and any associated data. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

We do not guarantee the accuracy of card identification, pricing data, or condition assessments. The Service is a tool for collectors, and results should be verified independently for high-value decisions.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCARDO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE SERVICE EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE ACTION GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless Scardo and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Scardo operates, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction, as applicable.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Scardo regarding the Service and supersede all prior agreements and understandings.
